These Terms of Service ("Terms") govern your use of the Faye mobile application and website (collectively, the "Service"). Please read these Terms carefully before using Faye. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by use of any such third-party services.

Faye is not a medical device or healthcare provider. The Service provides informational content related to menstrual cycles and does not provide medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions about your medical condition.

The Service is provided on an "as is" and "as available" basis without any warranties of any kind. We do not guarantee that the Service will always be available, uninterrupted, or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, in no event shall Ebenezer Don, Faye, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

You agree to defend, indemnify, and hold harmless Ebenezer Don, Faye, and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or your violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. For significant changes, we will provide notification via the app. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms that cannot be resolved through negotiation shall be subject to the exclusive jurisdiction of the courts of Delaware.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of the Terms will continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Faye regarding the Service and supersede all prior agreements and understandings.
